My letter was prompted by a great article this morning in American Greatness by Julie Kelly, who has been doing some of the best reporting —- actual journalism, an endangered species if ever there was one— on the January 6 “armed” “insurrection” at the Capitol (the first one in history in which not a single firearm was discovered) and specifically about the glaring double standard of the Harris-Jarrett-Rice “Administration” of these citizens as compared with the real criminals of the Summer 2020 “peaceful” protests. In her article, entitled “Justice Department Administers Unequal Justice, GOP Pen a Letter”, she notes that five Senators, including one of my own, Rick Scott, asked questions about the glaringly unequal treatment involved in the Jan. 6 cases:
Senators Ron Johnson (R-Wisc.), Mike Lee (R-Utah), Ted Cruz (R-Texas), Rick Scott (R-Fla.) and Tommy Tuberville (R-Ala.) asked Garland to explain the “potential unequal justice administered in response to other recent instances of mass unrest, destruction, and loss of life throughout the United States.”
Without naming Antifa or Black Lives Matter—instead referring to the violence as “2020 social justice protests”—the senators pointed out that Garland’s prosecutors are dropping cases against Portland rioters while throwing the book at Capitol trespassers. “DOJ’s apparent unwillingness to punish these individuals who allegedly committed crimes during the spring and summer 2020 protests stands in stark contrast to the harsher treatment of the individuals charged in connection with the January 6, 2021 breach of the U.S. Capitol Building in Washington, D.C..”
As American Greatness has reported for months, dozens of people arrested in connection with the Capitol protest have been denied bail and held in solitary confinement conditions in a D.C. prison for months. The senators asked how many “Spring and Summer 2020 Unrest” protesters faced similar treatment. “How many of these individuals are or were placed in solitary confinement? What was the average amount of consecutive days such individuals were in solitary confinement?” They asked the same questions about January 6 protesters.
They also noted the Justice Department has a publicly-available website that lists all the January 6 defendants and their crimes while no such database exists for “Summer of Love” protesters. “Americans have the constitutional right to peaceably assemble and petition the government for a redress of grievances. Violence, property damage, and vandalism of any kind should not be tolerated and individuals that break the law should be prosecuted. However, the potential unequal administration of justice with respect to certain protestors is particularly concerning.”
I should note that I have almost totally given up on writing letters to my “representatives” in Congress—or calling them or sending smoke signals or attempting any other form of communication whatsoever with that anointed class of elites—as it never, never, never produces any result but, as with my Congressman, Matt Gaetz, the same form letter, over and over and over again! However, this “strong letter” of a tiny fraction of Congress sent a signal so loud and clear to me as a complete waste of time I decided I would throw away a little of my time, knowing full well it will come to nothing. Here is my letter, for what it’s worth:
Senator Scott, while I applaud your letter, along with Senators Lee, Cruz, Johnson and Tuberville, to AG Garland and while I could not possibly agree more with the position you expressed in that letter, I have to ask, with all due respect, the following question:
Why did it take this long for members of Congress-- and only five our of the entire Republican membership of the House and Senate at that- to try to get something done for these poor American citizens who are being treated like they were some Soviet political prisoners because they were INSIDE THEIR, and I emphasize THEIR, public building exercising their right under the United States Constitution and the Bill of Rights to peaceably assemble? These people have been subjected to conditions which might come close to shocking the conscience and bordering on the "cruel and unusual punishment" prohibited by the Eighth Amendment as many of them, according to news reports, have been kept in solitary confinement for no apparent reason whatsoever. I read about your letter in a column this morning by Julie Kelly of American Greatness who has been doing the best reporting on the despicable way these AMERICAN CITIZENS -sorry for the all caps but it is abhorrent that citizens are being treated like animals like this-- are being persecuted while, as your letter points our, Antifa and BLM "peaceful protestors" are not paying any price whatsoever for conduct a million times worse.
I must also ask, again with all due respect, why are you all wasting your time writing letters to anyone in this God forsaken "administration" when you know they are going to just ignore you and your letter?
Why in the world are you not immediately issuing subpoenas for Garland and his DC attack dog persecutors to appear before a Senate Committee under oath and respond to your questions? Yes, I am aware that the Socialist Party is in the majority but have you and your colleagues made any effort to find any Democrats whose constituents may feel the way you do on this matter? Surely, ALL Democrats have not just totally given up on the Rule of Law; if they have, our Republic truly has little or no future.
Please respond to my specific questions and please do not send me another form letter; I already have plenty of those and would sincerely like to hear from you on what I genuinely believe, based on many decades as a practicing attorney, to be a grave miscarriage of justice.

More and more lately, especially, of course, after the frighteningly incompetent administration of Kamala Harris (God Help Us) came into office, I see comments and articles and commentary asking, in effect, what can we do to try to stem the tide of far-far-leftism taking root in so many areas of our National life? This letter represents my attempt to revive some kinds of efforts in that regard, as ineffectual as it is likely to be. However, I do have this question to ask of anyone who would care to offer an opinion: what can we lowly plebs and deplorables do to start pushing back against this tsunami of Marxist-Socialism now eroding the very structures of the Greatest Nation ever devised by the mind of man?
